WARRANTY PROCEDURE FOR SPECIAL TOOLS

I. Handling Procedure for Warranty of Special Tools
Mercedes-Benz of North America, Inc. (MBNA) warrants each special tool to be free from defects in workmanship and material for a period of six (6) months from the date of delivery to the original purchasing dealer. MBNA will at its discretion, provide credit for initial purchase price, replacement, or repairs of any parts found to be defective upon inspection by an authorized Mercedes- Benz representative, except those tools which are covered by a separate warranty published by the individual manufacturer.
The warranty shall not apply to any special tools which have been subject to misuse, negligence or improper maintenance.
II. Special Tool Claims Procedure
A. Filing of MBNA Form 485 (Rev. 10-81), "Warranty Claim for Mercedes-Benz Special Tools"
1) Preparation Instructions
When a warranty claim is filed, the dealer should complete MBNA Form 485. This form must be signed by the dealer or person designated by the dealer having responsibility for such transactions.
The claim form must indicate the MBNA part number, description, invoice number, dealer price and date. A brief description of the tool's defect should also be provided.
Warranty claim should be accompanied by a copy of parts invoice (proof of purchase).
2) Mailing Instructions
Two (2) copies of MBNA Form 485 (Rev. 10-81) and the defective part, are to be sent by parcel post to the address listed below:

B. Warranty Claim Handling of Mercedes-Benz Special Tools.
1) Tagging of Claim Tools
Each item being returned as defective must be identified with a Return Parts Identification Tag MBNA Form 420, which must be properly completed and attached to the part.
The tag must indicate the MBNA part number and description.
2) Packing Instructions
All items must be cleaned prior to packing and drained of fuels and lubricants, if applicable.
Items must be packaged so as to prevent damage during shipment.
C. Notice of Decision on Warranty Claims Filed:
1) Approved Claims
On approved warranty claims the returned item will be replaced, repaired or reimbursed at MBNA's discretion. The dealer will be advised in writing as to the action taken on the claim.
2) Claims Not Approved
Claims requiring additional information, correction or clarification will be returned along with the affected tool to the dealer. The necessary correction or additional information requested must be indicated on the claim and should be resubmitted immediately, otherwise the claim may be disallowed.
D. Claim Forms:
MBNA Form 485 (Rev. 10-81) "Warranty Claim for Mercedes-Benz Special Tools" will be furnished without charge upon dealer's request to:

E. Termination of Dealer Sales or Service Agreement:
Upon termination of dealer sales or service agreement with MBNA, all rights of the dealer under the aforementioned claims procedure set forth herein shall end.
